By using the RocketBid.com web site (the "Site"), you agree to the following terms of use (the "Terms of Use"). This Site is owned and operated by Rocket Bid LLC (hereafter, "RocketBid" or "Company").

RocketBid reserves the right to change the terms, conditions, as well as the notices at any time. Therefore, such modifications shall be effective immediately upon posting of such changes. YOU AGREE TO READ THESE WEBSITE TERMS OF USE CAREFULLY BEFORE EACH USE OF THIS SITE. IF YOU DO NOT AGREE WITH THESE TERMS OF USE, DO NOT USE THIS SITE. Your continued access of this website shall be deemed your conclusive acceptance of the modified agreement.

You will not use this Site in any way that is contrary to these Terms of Use, or that is unlawful or harms Rocket Bid LLC, their service providers, affiliates, sub-licensees, resellers, distributors, advertisers, users of this Site, or the network to which it is connected. RocketBid reserves the right, in its sole and absolute discretion, to terminate, suspend or restrict your access to this Site, unilaterally and without notice, in the event you violate any of the Terms of Use. In addition, if asked to do so, you agree that you will not attempt to access this Site. We also reserve any and all remedies at law or equity in connection with any violation of the Terms of Use. You agree, at your own expense, to indemnify, defend and hold the Company (and its subsidiaries, affiliates, officers, directors, agents, employees and third parties providing content) harmless from and against any claim or demand and all losses incurred related to the use of the Site.

If RocketBid learns of a violation RocketBid may, in its sole discretion, take any or all of the following actions: remove the offending content; issue a warning; suspend or terminate any service on the Site, and take any other action RocketBid deems reasonable and allowed by law. RocketBid reserves the right to fully cooperate with any third-party investigations of alleged illegal or improper activity related to the Site. RocketBid reserves the right to reject or revise any content at any time for any reason and could monitor any communications using network facilities. This includes efforts to prevent the introduction of viruses or other hostile code or ensure compliance with laws and our guidelines, procedures and technical requirements or otherwise. However, RocketBid is under no obligation and does not assume any obligation to monitor the information residing on or transmitted to the Site. Any violation should be reported immediately to abuse@rocketbid.com.

Obtaining material or data through the use of this Site is at your own discretion and risk. You are solely responsible for any damages to you, your computer system or loss of data resulting from the use or download of such material or data.

You understand that all postings, text, messages, images, photos, files, video, sounds, or other materials (hereafter, "Content") transmitted through, posted on, or linked from the Site are the sole responsibility of the person from whom the content originated. In no event shall RocketBid, its officers, directors, affiliates, employees, agents and successors be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss or damage of any kind incurred as a result of the use of any content posted, emailed or otherwise made available via the Site. You agree that you must evaluate, and bear all risks associated with the use of any content and not rely on said content. You acknowledge that RocketBid does not pre-screen or approve content.

All content and services available through the Site are completely independent of Rocket Bid. Your interactions with individuals and/or organizations found on the Site are solely between you and such organizations and/or individuals. An interaction with any individual and/or company is at your own discretion and risk. You agree to make whatever investigation you deem necessary or appropriate before proceeding with any online or offline dealings with any of these third parties. Rocket Bid is not responsible for any damages whatsoever resulting from loss or damage of any kind incurred as a result of any transactions with any third parties.

Disputes

RocketBid is under no obligation to become involved in disputes between any participants on this Site including but not limited to users and any third party. In the event that you have a dispute with one or more of the participants, you hereby release RocketBid, its officers, directors, affiliates, employees, agents and successors in rights from claims, demands and damages (consequential, actual, and incidental) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes and your dealings with third parties.

RocketBid makes no guarantees to the amount or quality of postings nor availability, quality, or number of providers. RocketBid does not endorse or recommend any individuals and/or organizations. Third parties associated with RocketBid are neither employees nor agents of RocketBid, nor is RocketBid an agent of the third party.

The Site is a service provided, controlled and operated by Company, which has its principal place of business in the State of Arizona, United States of America. RocketBid makes no representation that the Site is available or appropriate for users in all jurisdictions. You acknowledge that users access the Site on their own initiative and are responsible for compliance with all applicable laws, regulations and treaty provisions. These terms and conditions and your agreement to be bound by them shall, to the maximum lawful extent, be governed by and construed in accordance with the laws of Arizona without reference to principles of conflicts of laws. You agree that the State and Federal courts located in Arizona shall be the exclusive forum for the resolution of all disputes between you and us relating to your use of the Site. You hereby consent to the personal jurisdiction of these courts to the extent permitted by applicable law and RocketBid waives the right to a trial by jury. Such disputes shall be resolved and finally settled by mutually binding arbitration conducted in accordance with the commercial arbitration rules of the American Arbitration Association by one arbitrator appointed in accordance with said rules. The location of the arbitration shall be in Maricopa County, Arizona. The arbitrator shall apply Arizona law without reference to conflict of laws principles.

You agree that all content posted on the Site (including any ratings and reviews) is the sole and exclusive property of RocketBid. You have no right to post, publish, reproduce or reuse such information other than for personal use relating to your RocketBid posting. You agree and acknowledge that violating the foregoing could result in significant damages and agree that you are liable for any such damages and will indemnify RocketBid in the event of any third party claims based on or arising from your violation of the foregoing. No content made available on or through the Site can be copied or redistributed without the written consent of an officer of Rocket Bid LLC.

All Ratings and Reviews of a contractor or service professional displayed reflect the opinions of consumers and do not reflect or represent the opinions or representations of RocketBid. Ratings and reviews do not reflect the views of RocketBid, its officers, directors, affiliates, employees, agents or successors subsidiaries. RocketBid assumes no responsibility or liability for any rating or review or for any claims, damages, or losses resulting from any use of the Site or the materials contained therein. RocketBid reserves the right, but is not obligated to refuse to post or to remove any Review if RocketBid determines (in its sole discretion) that it contains or features any of the following:

1. Offensive, harmful and/or abusive language, including without limitation: profanities, expletives, obscenities, vulgarities, harassment, sexually explicit language and hate speech (e.g., racist/discriminatory speech).
2. References to illegal activity.
3. Reviews that are personal in nature not relating to the service provided.
4. Comments wrongfully placed.
5. False statements or those that appear to be false.
6. Disparaging comments toward RocketBid.

Indemnification

YOU AGREE TO INDEMNIFY ROCKETBID, AND ITS OFFICERS, DIRECTORS, AFFILIATES, EMPLOYEES, AGENTS AND SUBSIDARIES AND HOLD THEM EACH HARMLESS FROM ANY AND ALL CLAIMS OR DEMANDS, INCLUDING ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING FROM YOUR USE OF THE SITE OR IN CONNECTION WITH ROCKETBID OR YOUR VIOLATION OF THESE TERMS AND CONDITIONS, OR ARISING FROM YOUR VIOLATION OF ANY RIGHTS OF A THIRD PARTY.

Anti-Spam Policy

Users of this Site shall not use this Site to transmit unsolicited e-mail messages, including without limitation, unsolicited bulk e-mail, where such e-mails could reasonably be expected to provoke complaints ("spam"). Further, you are prohibited from obtaining the service of another provider to send spam to promote a site hosted on this Site.

Passwords

In order to access certain Sites and services, you may be required to enter a user name and password on the Site. You agree to not permit any other individual or entity to access the Site with your user name or password. You agree to log off from your account after each session on the Site. You agree to hold you user name and password in confidence, not to disclose either to any other individual or entity. You agree to notify RocketBid immediately in the event you determine that another party has gained access to your password or user name or accessed the Site using your user name or password. You agree not to access or attempt to access any areas of this Site or through this Site that are not intended for general public access, unless provided with express written authorization by RocketBid. You agree that you will not disrupt the functioning of this Site or otherwise act in a way that interferes with other users' use of the Site. RocketBid reserves the right to use discretion in such an event to change or modify the username and reset the password.

Email List

All subscribers are automatically added to the RocketBid email list to receive product updates, special offers and policy change information. You will continue to receive updates on submitted projects until project has been accepted and reviewed, terminated or timed-out. You can remove yourself from our mailing list by deactivating your account at any time.

Web Site

RocketBid’s advertised website included in the "Web" plan maps directly to a RocketBid html script that generates the website html based on the information entered in profile/settings. RocketBid does not provide ftp access for "Web" subscribers. Custom solutions are available to meet client needs. For more information, email sales@rocketbid.com.

Domain Name

Rocket Bid LLC reserves all domain names (with exception to those previously owned and transferred) and continues to pay all annual fees associated with the domain name so long as the "Web" subscription associated with the domain name is active. Upon downgrading or termination of the subscription, the domain name could be lost through expiration. RocketBid agrees to transfer the domain name to the user at anytime, for no fees other than third party transaction fees.

Time taken to transfer a domain name may cause the loss of content, features, email, or capacity of your account. RocketBid does not accept any liability for such loss.

Refund Policy

All fees are due immediately and are non-refundable unless otherwise expressly noted, even if your services are suspended, transferred, or terminated prior to the end of the billing cycle. RocketBid expressly reserves the right to modify its pricing through email notification and/or notices made available on the Site. Payment may be made by you providing a valid credit card (Visa or MasterCard only). Your monthly billing date will be determined based on the day of the month you purchased the service unless that date falls after the 28th of the month in which case your billing date will be the 28th of each month and is billed in advance. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. There are no exceptions. For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle. An upgrade from a free plan to any paying plan will be immediately billed. . If for any reason RocketBid is unable to charge your payment method for the amount owed, you will be notified and given 3 days to update or provide new credit information. RocketBid assumes no liability for notifications not received. If payment method is not resolved within the given timeframe, the account will revert to a free plan. DOWNGRADING YOUR SERVICE VOLUNTARILY OR INVOLUNTARILY MAY CAUSE THE LOSS OF CONTENT, FEATURES, EMAIL, OR CAPACITY OF YOUR ACCOUNT. ROCKETBID DOES NOT ACCEPT ANY LIABILITY FOR SUCH LOSS. You agree that you are solely liable for arranging your payment method to be in working order. RocketBid is not liable to you or any third party if it is unable to charge your payment method in order to renew your services. All transactions are processed in US dollars.

Promotions

By accepting this agreement, Subscribers (Free, Pro, and Web) will redeem RocketBid coupons and/or promotions during promotional periods.  RocketBid promotions are not valid with any other Subscriber’s own promotions or coupons. Promotions or coupons will not have to be accepted in addition to any promotional price or coupon being offered by the Subscriber.
